Sea Area Use Demonstration Service

Overview:

Sea area use demonstration is the scientific basis for approving project sea area use. For exclusive sea area use activities that continuously use specific sea areas for more than three months within the internal waters and territorial sea of the People's Republic of China, sea area use demonstration shall be carried out in accordance with relevant regulations.

 

Demonstration Principles

Adhering to the principles of scientificity, objectivity and fairness. Adhering to conservation first, promoting the rational development and sustainable utilization of sea area resources; adhering to protection first, realizing the unification of ecological, economic and social benefits; adhering to ecological sea use, promoting the construction of marine ecological civilization; adhering to land-sea coordination, determining land use based on sea area conditions, promoting coordinated regional development; adhering to national interests first, safeguarding national defense security and national maritime rights and interests.

 

Demonstration Basis

Including complete and effective laws, regulations, rules and normative documents, as well as relevant standards and specifications, and project technical materials such as engineering feasibility study reports and preliminary design reports shall also be referred to.


Demonstration Content

Necessity Analysis of Project Sea Area Use: Analyzing the necessity of project construction, and the advantages and irreplaceability of project sea area use compared with other alternative solutions. For example, for port construction projects, it is necessary to explain the demand of the regional economic development for ports, and the rationality and necessity of the port site selection.

Overview of the Sea Area Where the Project Is Located: Including the natural environmental conditions of the sea area, such as topography, hydrology and meteorology, marine ecology, etc.; the social and economic status of the sea area, such as the surrounding industrial layout, population distribution, etc.; and the current status of sea area development and utilization, including existing sea area use projects, ownership status, etc.

Coordination Analysis of Sea Area Development and Utilization: Analyzing the mutual influence between project sea area use and existing surrounding sea area use projects, and the compliance with marine functional zoning and relevant plans. For example, whether the project sea area use conflicts with surrounding aquaculture areas, protected areas, etc., and whether it meets the functional positioning of the sea area in the marine functional zoning.

Compliance Analysis of Project Sea Area Use with National Territorial Spatial Planning: Reviewing whether project sea area use meets the requirements of national territorial spatial planning, including whether it conflicts with marine ecological protection red lines, urban development boundaries, etc., and whether it is conducive to the overall development of the region.

Analysis of Project Sea Area Use Plan: Analyzing the sea use pattern, sea area use area, sea area use period, etc. of the project, and evaluating its rationality and feasibility. For example, for land reclamation projects, it is necessary to analyze whether the reclamation area is reasonable, and whether it will cause irreversible impacts on the marine ecological environment; whether the sea area use period matches the construction and operation cycle of the project.
